Terms of service
Scope
These terms apply to the use of the website switchfile.io and the API at api.switchfile.io (together "switchfile"). switchfile is operated by Aura UG (haftungsbeschränkt), Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany ("we"). Terms of users that differ from these terms do not apply unless we agree to them in writing.
The service
switchfile converts files from one format to another, on the website and through the API.
- Free use: up to 50 files a day with up to 1 GB per file, without an account. Some video conversions also count against a daily processing time. The converter tells you when a limit is reached.
- A free account adds API keys and the dashboard, and includes the daily free files.
- Paid plans and credit packs are described on the pricing page. They cannot be booked on the site yet. The section Paid plans and payment applies once they start.
The list of supported conversions is on the website. We develop switchfile further and may change formats and functions or remove them, as long as this is reasonable for you.
Paid plans and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
When you buy a paid plan or a credit pack, your purchase contract is with Paddle, and Paddle's buyer terms apply to the purchase. Paddle takes the payment and issues the invoice, with VAT where it is due. These terms continue to apply to your use of switchfile.
Before you buy, the checkout shows the price including VAT and, for a plan, that it renews every month. We add the plan or the credits to your switchfile account once Paddle confirms the payment. A plan renews every month until you cancel it. You can cancel at any time with effect from the end of the current billing month.
Refunds and the right of withdrawal are described in our refund policy.
Account and API keys
Give correct information when you sign up and keep your email address up to date. Keep your password and your API keys confidential and do not share them with others. You are responsible for all use of your account and your API keys, unless you are not responsible for the misuse. If you think someone else knows a key or your password, revoke the key or change the password right away. Please also let us know.
Using the API in your product
You may build the API into your own apps and services and offer conversions to your own customers. You are responsible for how your users use switchfile through your integration, and for informing them about the processing of their data. These terms also apply to files your users send through your integration.
Prohibited use
You must not use switchfile to:
- upload or share illegal content, including content that infringes the rights of others
- process files you do not have the rights to convert
- spread malware or use files to attack us or others
- get around limits, for example with several accounts or with automated requests that bypass the daily free quota
- attack or overload our systems, or interfere with their operation in another way
Your files
All rights to your files and to the results stay with you. You grant us only the right to store and convert your files to the extent and for as long as this is needed to provide the conversion you asked for. You confirm that you have the rights needed for this.
Deletion and backups
We delete uploads and results 24 hours after a conversion finishes. We do not keep backups of files. Download your results in time and keep your own copies of your original files. After deletion, we cannot restore a file.
Conversion results
Formats differ in what they can hold. Depending on the formats and settings, a conversion can change or lose quality, layout, content or metadata. We do not promise that a result matches the original exactly. Check results before you rely on them.
Availability
We work to keep switchfile available, but we do not promise a specific uptime. Maintenance or faults can make the service unavailable for a time, and so can events outside our control.
Blocking and ending use
If there are concrete signs that you break these terms or the law, we may limit or block your access or individual API keys, temporarily or permanently. We take your legitimate interests into account and choose the mildest measure that is enough. You can stop using switchfile at any time. To delete your account, write to [email protected].
Reporting illegal content
You can report content that you believe is illegal to [email protected] (Art. 16 of Regulation (EU) 2022/2065). Please include:
- why you think the content is illegal
- where it is, for example the link to the file or the ID of the conversion
- your name and email address
- a statement that you believe in good faith that the information in your report is correct and complete
We confirm receipt and tell you what we decided. Files are not public and are deleted 24 hours after a conversion finishes.
Liability
We are liable without limitation for intent and gross negligence. The same applies to injury to life, body or health and to liability under the German Product Liability Act.
For slight negligence we are liable only if we breach an essential contractual obligation. Essential obligations are those that make proper performance of the contract possible in the first place and on which you may regularly rely. In this case our liability is limited to the damage that is typical for the contract and foreseeable when the contract was concluded. Apart from that, we are not liable for slight negligence.
These limitations also apply to the personal liability of our legal representatives and of the people we use to perform the contract.
Changes to these terms
We may change these terms for the future, for example when we add functions or the law changes. We inform account holders by email at least four weeks before a change takes effect. If you do not agree, you can delete your account before that date, and a paid plan can also be cancelled with effect from that date. The date at the top shows the current version.
Applicable law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not take away the protection of the mandatory consumer protection rules of the country where you usually live.
If you are a merchant, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office in Hamburg. The same applies to legal entities and special funds under public law.
